Moves With You · Operated by Competitive Sports Foundation, Inc.
Welcome to Moves With You. These Terms of Use explain the rules for using our website, creating an account, joining activities, registering for events, and participating in our virtual journeys.
By creating an account, registering for an activity, or using the website, you agree to these Terms.
Participation in physical activities also requires acceptance of our separate Participant Agreement, Assumption of Risk and Release of Liability.
1. Who We Are
Moves With You is operated by Competitive Sports Foundation, Inc. (CSF), a 501(c)(3) nonprofit organization based in Gadsden, Alabama.
CSF provides community-based opportunities for physical activity, recreation, and wellness.
Moves With You is not operated by or part of any city, county, or state government, even when a city's name appears in the website address.
Cities, public agencies, businesses, and community organizations may provide facilities, funding, equipment, or other support without becoming operators of the Program.
Questions about these Terms may be sent to info@competeagain.org.
2. The Program
Moves With You offers fitness classes, group walks, recreational activities, virtual journeys, instructional videos, and community events.
Most activities are free. Certain special events or optional products may have a fee, which will be disclosed before payment.
Activity schedules, instructors, routes, locations, and availability may change.
We will make reasonable efforts to notify registered participants about material changes or cancellations affecting their activities.
CSF may modify, suspend, or discontinue activities or features for operational, safety, funding, or other legitimate reasons.
3. Your Account
You must be at least 19 years old to create a household account under the Program's standard registration rules.
You may register eligible household members, including minors, for activities appropriate to their ages and abilities.
By using an account, you agree to:
- Provide accurate and current registration information.
- Register only people you are authorized to enroll.
- Keep your account access and email sign-in codes secure.
- Update information when your contact details or household circumstances change.
- Avoid allowing unauthorized individuals to use your account.
- Follow applicable registration, eligibility, and activity requirements.
You are responsible for activity conducted through your account to the extent permitted by law.
Parents and legal guardians are responsible for the registration information and authorizations they provide concerning minors.
CSF may suspend or restrict an account when reasonably necessary to address fraud, misuse, safety concerns, or violations of these Terms.
4. Health, Safety, and Participant Agreements
Physical activity and recreation involve risks, including injury, illness, and, in rare circumstances, death.
Participants should select activities appropriate for their abilities, follow reasonable safety instructions, and stop participating if they experience concerning symptoms.
CSF does not provide individualized medical advice, diagnosis, or treatment.
Exercise videos, recipes, route maps, fitness suggestions, and other educational materials are provided for general informational purposes and are not substitutes for professional medical advice.
Required Participant Agreement
Before participating in Program activities, participants must complete the applicable Participant Agreement, Assumption of Risk and Release of Liability.
The Participant Agreement is separate from these Terms and includes provisions addressing:
- Voluntary participation and assumption of risk;
- Release of certain legal claims, including claims involving ordinary negligence, to the extent permitted by Alabama law;
- Personal safety responsibilities;
- Emergency assistance;
- Participation and supervision of minors;
- Independent activities and virtual journeys;
- Photography and video recording.
The Participant Agreement controls matters specifically addressed by that agreement. These Terms do not expand any release beyond what applicable law permits.
Minors
A parent or legal guardian must provide the authorization required by CSF before a minor participates.
Unless an activity is expressly designated as a supervised youth activity, parents or guardians remain responsible for appropriate supervision.
Safety and Incident Records
CSF may document accidents, injuries, or safety incidents when reasonably necessary for emergency response, operational safety, insurance, or legal compliance.
The collection, use, and retention of this information are described in our Privacy Policy.
5. Special Events and Additional Requirements
Some Program events involve risks beyond those normally associated with walking or general fitness instruction.
These may include strenuous fitness competitions, cycling events, paddling activities, organized races, or recreational sports clinics.
Registration for certain events may require:
- An additional event-specific risk acknowledgment;
- Minimum-age or eligibility requirements;
- Parent or guardian authorization;
- Safety instructions or required equipment;
- Other participation conditions appropriate to the activity.
Participants must complete applicable requirements before taking part.
CSF may postpone, modify, suspend, or cancel an event when weather, water conditions, equipment, staffing, or other circumstances create unacceptable safety risks.
Event-specific requirements supplement the general Participant Agreement.
6. Paid Events, Products, and Refunds
Most Moves With You activities are free. Some special events and optional products may require payment.
Prices and applicable fees are shown before purchase.
Payments are processed through Stripe. CSF does not receive or store complete payment-card information.
Event Cancellations
- Cancellations made at least 48 hours before an event's scheduled start are eligible for a full refund.
- Cancellations made less than 48 hours before the scheduled start are not eligible for a refund under the standard cancellation policy.
- If CSF cancels a paid event, the participant will receive a full refund of the event registration fee.
Any exception, alternative refund arrangement, or event-specific cancellation policy will be disclosed when applicable.
Fee Assistance
Some activities may offer fee-assistance codes. Participants may use valid codes at checkout without being required to explain their personal financial circumstances.
Optional Merchandise
Optional products, including finisher medals when offered, may be sold through a third-party checkout provider.
Applicable product prices, shipping charges, fulfillment terms, and any product-specific return conditions should be displayed before purchase.
7. Respectful Participation and Community Conduct
We want Moves With You to be welcoming, accessible, and safe.
Participants agree to:
- Treat others with respect.
- Follow reasonable instructions from activity leaders and event personnel.
- Avoid harassment, threats, discrimination, intimidation, or deliberately unsafe behavior.
- Respect public spaces, private property, facilities, and equipment.
- Follow applicable laws and posted rules.
- Avoid disrupting activities or preventing others from participating safely.
CSF may restrict or end participation when reasonably necessary to protect participants, personnel, or the public.
8. Photography and Recording
Photography and video recording may occur during Program activities, particularly in public parks, streets, trails, recreational facilities, and community event spaces.
CSF and its authorized representatives may photograph or record activities for documentation, community reporting, and Program promotion in accordance with the Participant Agreement and Privacy Policy.
Participants may take personal photographs in public settings where legally permitted.
However, participants must respect others' privacy and safety.
Harassing or intrusive photography, recording in private areas, or using someone's image unlawfully or in a materially misleading manner is prohibited.
Participants must follow photography restrictions established by facility operators or event personnel.
The Participant Agreement describes CSF's media permissions, privacy-request procedures, and additional safeguards for identifiable images of minors.
Questions or requests concerning images published by CSF may be sent to privacy@competeagain.org.
9. Emails, Texts, and Notifications
CSF may send administrative communications necessary to manage accounts, registrations, waivers, activity changes, or safety notices.
Optional reminders and other communications are managed through available account preferences.
Reminder emails are enabled when participants register and include an unsubscribe option.
Text messages are sent only when participants enable them.
Message frequency depends on registered activities and selected notifications.
Participants may reply STOP to stop text messages or HELP for assistance. Message and data rates may apply.
Changes to notification preferences do not necessarily prevent essential transactional, legal, or safety communications.
10. Videos, Maps, Recipes, and Other Content
Moves With You may provide workout videos, route maps, recipes, guides, illustrations, and educational materials.
These materials are intended for personal, noncommercial use unless otherwise stated.
Participants may not reproduce, redistribute, sell, or commercially exploit Program-owned videos or other protected materials without appropriate authorization.
Recipes may be provided through USDA MyPlate Kitchen and MyPlate.food, with their original sources identified.
Map features may use OpenStreetMap data and other supporting services.
Maps and suggested routes are informational resources. They do not guarantee that a location, route, surface, or activity is safe, accessible, open, or appropriate for a particular participant.
Users should follow local rules and assess current conditions before beginning an activity.
Trails listed in the app are for walking on your own. Walking them is not a supervised activity, and the Participant Agreement you signed applies.
11. Virtual Journeys and Activity Records
Virtual journeys are optional activities that allow participants to record distances and follow progress toward designated milestones.
Participants agree to submit accurate information about activities they actually completed.
CSF may review, correct, or remove entries that reasonably appear inaccurate, duplicate, fraudulent, or inconsistent with Program rules.
Activity entries may be entered manually or imported through supported third-party services when authorized by the participant.
Connecting a fitness-tracking service is optional.
Virtual journeys do not involve continuous supervision by CSF.
Participants choose where, when, and how they complete independent physical activities.
Recording an activity does not mean CSF organized, supervised, inspected, or approved that activity or location.
Information about journey records, optional integrations, and deletion schedules is provided in the Privacy Policy.
12. Privacy and Personal Information
CSF collects and uses personal information as described in the Moves With You Privacy Policy.
The Privacy Policy explains:
- Information collected during account creation and participation;
- Household and minor registration information;
- Activity records and optional integrations;
- Service providers and authorized personnel access;
- Photography and video records;
- Retention of electronically signed agreements;
- Account deletion and privacy requests.
Participants may review the Privacy Policy through the website.
13. Website Availability and Limitations
CSF makes reasonable efforts to provide accurate information and maintain a reliable website.
However, the website and its digital features are provided on an "as available" basis.
The website may occasionally contain errors, experience interruptions, or become unavailable.
To the fullest extent permitted by applicable law, CSF does not guarantee uninterrupted service, error-free operation, or the accuracy or suitability of every item of third-party content.
CSF's liability for losses arising from website use is limited to the extent permitted by applicable law.
Nothing in these Terms excludes liability that cannot legally be excluded or changes the scope of the separately signed Participant Agreement.
14. Account Suspension and Closure
Participants may request account deletion through available account controls or by contacting CSF.
CSF may suspend, restrict, or close an account when reasonably necessary to address misuse, fraud, safety concerns, or violations of these Terms.
Account deletion does not automatically delete signed waivers, incident records, or other information that must be retained for legal, insurance, or legitimate recordkeeping purposes.
The Privacy Policy explains the applicable retention and deletion procedures.
15. Updates to These Terms
CSF may revise these Terms when Program operations, technology, legal requirements, or available activities change.
The updated version will display its effective or revision date.
For material changes, CSF will notify account holders in advance when reasonably practicable.
Where additional affirmative acceptance is required, participants will be asked to review and accept the revised Terms before continuing to use applicable services.
Changes to these Terms do not retroactively alter the terms of previously signed Participant Agreements.
16. Governing Law and Other Provisions
These Terms are governed by the laws of the State of Alabama.
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
If English and Spanish versions are provided, both are intended to communicate the same requirements. Any material inconsistency will be resolved under applicable law, with the English version controlling to the extent legally permissible.
These Terms govern use of the Program's website and digital services. The Participant Agreement and any applicable supplemental event agreement govern the additional matters addressed in those documents.
